End-User License Agreement (“Agreement”)

Please read this Agreement (“Agreement”) carefully before playing our games, including but not limited to King’s Quart, or using this website.

By using this website and playing our games, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not use this website and leave immediately.

NOTICE: BY PLAYING OUR GAMES AND USING THIS WEBSITE, YOU ASSUME ALL RISK. CONSUMPTION OF ALCOHOL IS NOT REQUIRED TO PLAY THIS GAME. IF YOU CONSUME ALCOHOL WHILE PLAYING THIS GAME, DO SO RESPONSIBLY AND ONLY IF YOU ARE OF LEGAL AGE IN YOUR JURISDICTION. NEVER DRINK AND DRIVE OR ALLOW YOUR FRIENDS TO DRINK AND DRIVE. CALL AN UBER, STAY THE NIGHT, DO WHATEVER IT TAKES. BE SAFE AND HAVE FUN.

License

Toilet Paper Games, LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the game and website solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Restrictions

You agree not to, and you will not permit others to:

a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.

Modifications to Application

Toilet Paper Games, LLC reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.

Warranties Disclaimed

TOILET PAPER GAMES, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING OUR GAMES.

LIMITATION OF REMEDIES.

YOU AGREE TO DISCLAIM ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THIS APPLICATION. YOU AGREE THAT YOUR SOLE REMEDIES ARE EITHER THE REPLACEMENT OF THIS APPLICATION, OR A REFUND OF YOUR PURCHASE PRICE. IN NO EVENT WILL TOILET PAPER GAMES, LLC BE LIABLE FOR ANY INCOMPATIBILITIES OF THE SOFTWARE, OR FOR UNAUTHORIZED ALTERATIONS OF THE SOFTWARE BY YOU OR OTHER THIRD PARTIES.

Arbitration and Small Claims Court Venue.

You agree that any disputes arising under this Agreement shall be submitted to arbitration or small claims court. Any dispute resolution shall occur electronically, or in Clark County Washington. Toilet Paper Games, LLC has sole discretion in choosing an arbitrator. The Arbitrator shall apply the rules of the American Arbitration Association in resolving any disputes.

Choice of Law

You agree that in the event of any dispute arising from use of this game, you agree that any disputes will be resolved under the laws of Washington, without respect to choice of law rules.

Attorney’s Fees

You agree that to the fullest extent of the law, neither party shall be entitled to attorney’s fees for disputes arising from your use of our games and website.

Term and Termination

This Agreement shall remain in effect until terminated by you or Toilet Paper Games, LLC.

Toilet Paper Games, LLC may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from Toilet Paper Games, LLC, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.

Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Amendments to this Agreement

Toilet Paper Games, LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 (changes this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will update this Agreement at toiletpapergames.com/electronicterms
